1. Introduction
Welcome to THE LADY IN TOWN.CO.UK . These Terms of Service govern your use of our website and your inquiry about, and booking of, our live illustration services.
By submitting an inquiry form through our website or otherwise engaging our services, you ("Client," "you") agree to be bound by these Terms. If you do not agree, please do not submit an inquiry or book our services.
2. Services Offered
We provide live illustration services for weddings, corporate brands, and private events. Our standard packages are designed for a minimum of 40 guests. Detailed package descriptions, including number of guests, hours of coverage, and number of illustrations, will be provided upon inquiry and confirmed in your formal Service Agreement.
3. Inquiry and Booking Process
Submitting an inquiry form through our website is not a binding contract.
A formal Service Agreement will be provided to you after your inquiry is reviewed.
Your booking is confirmed only when:
You have signed the formal Service Agreement; and
We have received your non-refundable deposit.
Event dates are secured on a first-come, first-served basis upon receipt of the signed agreement and deposit.
4. Intellectual Property (CRITICAL)
This is the most important section of our Terms.
Ownership: All artwork, illustrations, sketches, and creative content created during your event (the "Artwork") remains the sole and exclusive intellectual property of ASTHA SETHI . We retain all rights, title, and interest, including all copyrights.
License to Client: Upon full payment of all fees, we grant you a non-exclusive, non-transferable, personal license to use the Artwork for non-commercial purposes related to your event. This includes:
Sharing on personal social media accounts (with credit to us).
Printing for personal keepsakes, wedding albums, or framing for personal display.
Restrictions: This license does not permit:
Commercial use (e.g., using the Artwork in advertising, product packaging, or merchandise) without our prior written consent and additional fee.
Alteration, editing, or modification of the Artwork in any way.
Reselling, sublicensing, or distributing the Artwork to third parties.
Our Right to Promote: We reserve the right to display the Artwork in our portfolio, on our website, on social media, and in marketing materials for promotional purposes. If you prefer that we delay sharing until after your event (e.g., for a wedding surprise), please let us know in writing at least 14 days before the event.
5. Client Responsibilities
To ensure a successful event, you agree to:
Provide a suitable working space at the event venue (e.g., a table, two chairs, and access to electrical outlets).
Ensure adequate lighting in the illustration area.
Inform your guests about the illustration activity and obtain their consent to be included in the Artwork.
Provide a detailed guest list or schedule if required for the package you have selected.
6. Payment Terms
Deposit: A non-refundable deposit of [e.g., 20%] of the total package price is required to secure your booking.
Final Payment: The remaining balance is due no later than [e.g., 7 days] prior to the event date.
Payment Method: Payments are processed offline via invoice or bank transfer .
Late Payment: If final payment is not received by the due date, we reserve the right to cancel your booking and retain the deposit.
7. Cancellation and Refund Policy
Cancellation by Client:
Cancellations must be submitted in writing via email.
If you cancel more than [e.g., 30 days] before the event: Your deposit is retained, but no further charges will apply.
If you cancel between [e.g., 14–29 days] before the event: You will be responsible for [e.g., 50%] of the total package price.
If you cancel less than [e.g., 14 days] before the event: The full package price is due and payable.
Cancellation by Us: If we are unable to perform the services due to circumstances beyond our control (e.g., severe illness, family emergency), we will notify you immediately and provide a full refund of any payments made. We will make reasonable efforts to find a suitable replacement illustrator, but we cannot guarantee this.
8. Limitation of Liability
To the fullest extent permitted by law:
Our total liability to you for any claim arising from our services or these Terms shall be limited to the total amount paid by you to us for the specific event.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, loss of profits, data, or goodwill) arising from our performance or inability to perform the services.
We do not guarantee that every guest will receive an illustration, as this depends on guest participation and time constraints. Our artists will work diligently to maximize the number of illustrations within the package time.
9. Force Majeure
We shall not be liable for any failure to perform our obligations if such failure is caused by events beyond our reasonable control, including but not limited to: acts of God, war, terrorism, strikes, government regulations, natural disasters, or public health emergencies. In such cases, we will work with you to reschedule the event or provide a partial refund of payments made, less reasonable expenses already incurred.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of United Kingdom
Any dispute arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation between the parties.
If negotiation fails, the dispute shall be resolved exclusively in the courts of United Kingdom
11. Amendments to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. For existing bookings, the Terms in effect at the time of your booking will apply.
12. Privacy Policy
Your privacy is important to us. Please review our separate Privacy Policy, available on our website, to understand how we collect, use, and protect your personal information (including your name, email, phone number, and event location).
